HB 438 -- MINIMUM PRISON TERMS

This bill provides that, notwithstanding any other provision of law, any offender who has a previous commitment to the Department of Corrections shall serve a minimum of 50% of his or her prison term for any subsequent offense and sentence.
The bill also repeals the current mandatory minimum prison term structure, which is based on whether an offender has a previous commitment to the Department of Corrections, for offenders who have been convicted of a felony other than a dangerous felony and replaces it with the requirement that such an offender who has three or more previous commitments to the Department of Corrections must serve 80% of his or her sentence.
This bill is similar to HB 2796 (2022).
