HB 866 -- ETHICS

SPONSOR: Mosley

This bill specifies that a person shall be unfit for elected public office or employment if, while holding office or employment, he or she is convicted of:

(1) Stealing campaign funds;

(2) Stealing caucus or associations funds or funds intended for a caucus or association;

(3) Expending campaign funds in violation of current law; or

(4) Converting campaign funds to his or her personal use in violation of current law.

Any person convicted of the above offenses will forfeit his or her office or employment. Any individual who knowingly appoints or retains an individual who has been found unfit for elected public office or employment shall also forfeit his or her office.

This bill also provides that any participant of a retirement plan established by the state or local government who is unfit for employment pursuant to this bill shall not be eligible to receive any retirement benefits from the plan.

This bill is similar to SB 220 (2023).
