HB 1081 -- PRIVACY PROTECTIONS

This bill amends provisions related to recording conversations. Currently, a wire or oral communication can be intercepted as long as one party to the conversation consents to the recording. Under this bill, all parties to the conversation must consent for the intercepting of the communication to be lawful. Additionally, a law enforcement officer may intercept a wire or oral communication if the officer obtains the communication in response to an emergency hostage situation. The bill provides other circumstances under which a person who is not a law enforcement officer may intercept a communication lawfully. The bill specifies that it is not unlawful for a person to place video or audio surveillance in the person's home unless there is a reasonable expectation of privacy.

This bill creates the offense of unlawful tracking of a motor vehicle, which a person commits if he or she knowingly installs, conceals, or otherwise places an electronic tracking device in or on a motor vehicle without the consent of all owners of the vehicle for the purpose of monitoring or following an occupant of the vehicle. The bill provides exceptions to the offense. The offense of unlawful tracking of a motor vehicle is a class A misdemeanor.
