SB 701 - Under current law, in an action brought under the Missouri Human Rights Act, a court may may award to the plaintiff actual and punitive damages, and may award court costs and reasonable attorney fees to the prevailing party, other than a state agency or commission or a local commission; except that, a prevailing respondent may be awarded reasonable attorney fees only upon a showing that the case was without foundation. This act repeals the provision allowing for reasonable attorney fees as well as the provision prohibiting a state agency from being granted court costs.
