HCS/HB 543 - This act enacts provisions relating to the towing of vehicles.

RETRIEVAL OF PERSONAL PROPERTY FROM TOWED VEHICLES (Section 304.155)

This act provides that a person whose abandoned property has been towed may have its contents released to him or her upon request.

The company holding or storing the abandoned property may require the owner of the abandoned property to complete documentation showing the property was released to the owner, and shall provide an itemized receipt for the property.

These provisions are identical to SB 572 (2023), and similar to HB 1262 (2018).

RELEASE OF TOWED COMMERCIAL VEHICLES (Section 304.156)

Under current law, an owner or lienholder of a vehicle that has been towed may file a court petition to determine whether the vehicle has been wrongfully taken or withheld, and have his or her vehicle released upon posting cash or a bond in the amount of the contested fees. This act provides that beginning October 1, 2024, the amount required for release of a commercial vehicle shall be 30% of the contested fees.
