HB 777 Modifies the certificate of need law

HCS/HB 777 - Under this act, determinations of need for long-term care facilities applying for a certificate of need shall not include any consideration for facilities or equipment of any other long-term care facility located more than a ten-mile radius from the applying facility in an urban area and more than a twenty-mile radius from the applying facility in a rural area. Additionally, an existing long-term care facility may be replaced in its entirety, if sharing the same owner, within ten miles of its existing site in an urban area and within twenty miles of its existing site in a rural area. Finally, any application for approval of new or additional beds in a long-term care facility may be denied if the minimum average occupancy of all existing licensed beds in the service area is not at least 80% of the most recent beds report.

This act directs the Missouri Health Facilities Review Committee to conduct ongoing reviews of the accuracy of bed counts and information in certificate of need applications, as well as to employ staff to perform the duties and administrative functions of the Committee.
