Current Bill Summary

SB 1159 - This act creates the "Missouri Nuclear Clean Power Act" with the purpose of enabling the construction of clean baseload electric generating plants, as defined in the act, placed into commercial operation after August 28, 2024, and to charge for the costs of construction work in progress, as defined in the act.

The provisions of this act shall not apply to a clean baseload generating plant if such plant is rated at three hundred megawatts or less. Before any such construction work begins, an electrical corporation seeking to include construction work in progress in its rates shall file a plan detailing the projected costs of such plan and a plan to recover such costs through rates with the Public Service Commission.

Costs recovered by an electrical corporation under this act are subject to inclusion or exclusion from rates in a ratemaking proceeding. If the Commission determines that such construction work was not completed within a reasonable time, the Commission shall reduce rates in an amount equal to all amounts recovered in advance by an electrical corporation from ratepayers as described in the act.

This act is similar to SB 928 (2024), SB 1461 (2024), HB 1435 (2024), HCS/HBs 1804 & 1435 (2024), SB 333 (2023), HB 1684 (2022) and HB 261 (2021).
