SB 1145 - This act establishes standards for a court to consider in rendering a decision involving custody of in vitro human embryos. The court shall presume that the best interests of the embryo shall be to grant custody to either the ovum donor or the spermatozoon donor who intends to develop the embryo to birth. The court shall resolve the dispute between the parties in the manner that provides the best chance for the embryo to develop and grow. The act lists the parties who have standing to intervene and permits a court to uphold an agreement between the parties to an action establishing or terminating parental rights as not against public policy. Decisions made by the court regarding the disposition of in vitro human embryos prior to August 28, 2024, shall be open to modification by motion or petition and shall be modified in accordance with this act. This act is substantially similar to SB 432 (2019) and HB 112 (2017) and similar to SCS/SB 1129 (2016) and HB 2558 (2016).
