Under the act, an action to enforce the powers of the Public Service Commission shall be commenced and prosecuted to final judgment by the Attorney General. No filing or docket fee shall be required of the Attorney General.
THE FAIR COMPETITION LAW (Sections 386.752, 386.754, 386.756, 386.760)
The act creates the Fair Competition Law.
The act modifies certain provisions relating to HVAC services.
Under the act, if the Public Service Commission receives information that provisions of the Fair Competition Law have been violated, the Commission shall conduct an investigation. Upon a finding that a violation occurred, the Commission shall ask the Attorney General to file a civil action. If the court finds that a violation occurred, the court may grant relief as discussed in the act.
Any person informing the Commission of any violation of the Fair Competition Law shall not be made party in an action by the Attorney General but may be allowed to intervene without being subject to any burden of proof on the initial filing of the intervention. Any person informing the Commission of any such violation, or any other interested person, shall be provided a copy of any investigation, settlement, order, or other disposition of the complaint upon a request, but not the work product of the Attorney General.
The Commission shall not adopt any rule, tariff, or order that may allow a violation of these provisions.
