HB 68 - This act modifies provisions relating to statutes of limitations for certain civil actions.

PERSONAL INJURY AND UNINSURED OR UNDERINSURED MOTORIST COVERAGE(SECTIONS 516.120 & 516.140)

Currently, actions for personal injury shall be brought within five years from the time the injury occurred. This act states that actions for personal injury that accrue on or after August 28, 2025, are to be brought within two years from the time the injury occurred. Additionally, current actions against an insurer that accrue on or after August 28, 2025, relating to uninsured motorist coverage or underinsured motorist coverage, including any action to enforce such coverage, are to be brought within ten years. This act modifies the statute of limitations for such actions to be brought within two years.

These provisions are identical to HB 1964 (2024), are substantially similar to provisions in SB 853 (2024), SB 117 (2023), SB 708 (2023), in SCS/SB 631 (2022), in SB 1243 (2022), in HCS/SCS/SB 119 (2021), and in HCS/HB 922 (2021), and are similar to HB 506 (2025), HB 272 (2023), HB 2206 (2022), provisions in SS/SB 3 (2021), HB 855 (2021), SB 633 (2020), SB 96 (2019), and SB 934 (2018).

CHILDHOOD SEXUAL ABUSE ACTIONS (SECTION 537.046)

This act provides that civil actions for recovery of damages suffered as a result of childhood sexual abuse shall be brought within twenty, instead of ten, years after the victim reaches the age of twenty-one or within three years of the victim discovering that the injury or illness was caused by childhood sexual abuse, whichever is later. This provision shall apply to any action commenced on or after August 28, 2025. Furthermore, this act modifies offenses included in the definition of "childhood sexual abuse".

This provision is similar to HB 114 (2025), in SB 148 (2025), in HCS/HB 219 (2025), SB 589 (2025), SB 747 (2025), HB 883 (2025), HB 1132 (2025), in SB 831 (2024) and HB 367 (2023).
