HCS/HBs 1363, 1062 & 1254 - This act prohibits municipalities from creating or enforcing rules that prevent school district property from being leased, sold, or transferred to a charter school for educational purposes. Municipalities are further prohibited from applying deed restrictions that block properties from being used by charter schools. Any deed restriction that allows for specific uses, but does not include educational use by a charter school, is prohibited. Any such restriction already in place when this act takes effect is void. When property is sold, leased, or transferred to a charter school, the agreement shall include terms about maintaining the property. Any rule, policy, contract, or deed that violates this act is void from its inception.
