Current Bill Summary

SB 1323 - Current law requires every child support order to include an income withholding order for the person obliged to pay the child support. If the income is not withheld immediately, the obligor's income shall be subject to withholding on the date on which the obligor becomes delinquent in an amount equal to one month's total support obligation. Under this act, the obligor's income shall be subject to withholding when an amount equal to one month's child support is delinquent or after ninety days of partial child support payments, whichever is earlier.

This act is identical to SB 623 (2025).
