HB 59 -- Child Support Delinquency
The bill requires circuit clerks to send a notice to child support obligors who are delinquent in an amount equal to 2 months payments if the obligee files an affidavit stating noncompliance or the clerk is the trustee for the payments. The notice includes: a statement that the obligor is delinquent; the amount of the obligation; and a statement of possible violation of the criminal nonsupport law. In addition, the bill requires the clerk to advise the obligor that if the obligor fails to respond within 5 days with good cause for failure to pay, the clerk will notify the prosecuting attorney.
