HB 77 -- Contracts: Automatic Renewal Clauses
Co-Sponsors: Champion, Hosmer
This bill prohibits automatic renewal clauses in contracts for goods or services without written notice to all parties to the contract except when the contract requires the party to perform, or deliver the goods or services to send written notification to all parties to the agreement. Notice must be sent at least 20 days and not more than 30 days before the renewal date of the agreement. When no party to the contract submits notice of termination before the renewal date, the contract is renewed on the terms of the renewal notice. Automatic renewal provisions in violation of this bill are against public policy, void, and unenforceable.
