HB 83 -- Criminal Records
The bill allows a person convicted of a nonviolent crime to apply to the court where the person was convicted to have records of the persons' arrest, plea, trial, or conviction expunged, if 5 years have elapsed since the person's conviction. A nonviolent crime is a crime that the court decides does not involve violence or the threat of violence.
In addition, the bill gives a person whose record has been expunged immunity from civil or criminal liability for failure to acknowledge the person's arrest, plea, trial, or conviction.
