HB 126 -- BOATS AND WATERCRAFT

COMMITTEE ACTION: Voted "do pass" by the Committee on State Parks, Recreation, and Natural Resources by a vote of 8 to 0.
The bill establishes a night-time speed limit of 35 miles per hour for boats on all waters of the state. Violators are guilty of a misdemeanor and subject to a fine of not more than $50 for the first offense, $250 for a second offense, and $500 for third and subsequent offenses. Further, in cases where a vessel's certificate of number is not available for inspection, the operator or the registered owner is guilty of a misdemeanor and subject to a fine of not more than $100.
FISCAL NOTE: Estimated Net Cost to General Revenue Fund of $58,950 in FY 96, $13,9905 in FY 97, & $14,322 in FY 98.
PROPONENTS: Supporters say that boating accident rates are increasing, and a night speed limit would greatly improve safety. Some lakes, especially Lake of the Ozarks, are becoming so dangerous that the tourism industry is threatened. Inspection of the certificate of number is necessary for large boats that are documented with the U.S. Coast Guard and are not required to display visible registration numbers.
Testifying for the bill were Representative Franklin for Representative Ward; Missouri State Water Patrol; Gene Sally; and the National Marine Manufacturers Association.
OPPONENTS: There was no opposition voiced to the committee.
