HB 228 -- Public Works Bonding
This bill explicitly states that no official, board, commission, commissioner, or agent of the state or any county, city, town, township, school, or road district is required to independently confirm the existence or solvency of any bonding company retained by a contractor performing public works. The bill also asserts the right of a public governmental body to defend and indemnify any of its officers or employees against any claim or demand arising out of an alleged act or omission occurring in the performance of a duty relating to public works contracts and bond requirements, provided that the officer or employee has acted in good faith.
