HB 249 -- Workers' Compensation
This bill requires any employer who provides accident and health insurance or life insurance for an employee to also provide equivalent insurance coverage for most health care services (including surgical, dental, drugs, pregnancy, child care, nursing care and treatment of mental illness or alcoholism) while the employee is receiving workers' compensation payments. Employers may self-insure, may purchase insurance, may create an injured employee's plan as an extension of any existing plan for working employees, or may use a combination of these methods. The Second Injury Fund will assume the cost of such coverage in any case where an employee's workers' compensation payments for permanent total disability continues beyond two years. Failure to provide such insurance coverage is a class A misdemeanor.
