HB 360 -- Process Servers
This bill requires all individuals wishing to serve process in this state to be licensed by the Department of Public Safety. The department will establish requirements for a training course for serving process. With departmental approval, any county sheriff may establish a training course for the service of process. The department will design licenses and identification cards for process servers and provide them to sheriffs. The identification cards will be signed by the sheriff and the presiding circuit judge in the county where the license was issued. The sheriff, with approval of the presiding judge, has the power of revoke licenses.
The bill also requires all individuals who have a license to issue process to pass an annual firearms qualification test approved or administered by a county sheriff in order to carry a concealed firearm.
The bill has an effective date of January 1, 1996.
