HB 449 -- Abortion
This bill allows public facilities, public employees, and public funds to be used for abortions when the mother suffers from a high-risk medical condition, the fetus has a lethal abnormality which will result in intrauterine or neonatal death, or the pregnancy is the result of rape or incest.
The bill also repeals the prohibition on counselors, social workers, and health care personnel who are public employees from counseling a woman to have an abortion. This provision of 188.210 RSMo as it applies to the conduct of such public employees (as opposed to an instruction to state fiscal officers not to allocate public funds) was ruled unconstitutional by the U.S. Supreme Court in Webster v. Reproductive Health Services.
