SB 956 - Paragraph (e) from Supreme Court Rule 1.8 is incorporated into statute, allowing attorneys to provide financial assistance to clients when: 1) the attorney advances certain costs of litigation; and 2) the attorney pays the costs of litigation for an indigent client. In addition to these circumstances, an attorney may guarantee a loan on behalf of a client if a client could not have otherwise pursued litigation due to pressure from the opposing party to settle the case because the client has run out of money.
This act is similar to SB 955, which repeals that part of
the Supreme Court Rule that is incorporated into statute.
