SENATE BILL NO. 482

AN ACT

Relating to the administration of the judiciary.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF MISSOURI, AS FOLLOWS:

Section 1. 1. Except for the circuit clerk in the city of St. Louis, beginning January 1, 1997, an additional five thousand dollars compensation annually shall be added to the base salary of each circuit clerk or circuit clerk ex officio recorder and payable to such persons, if such persons have completed at least twenty hours of classroom instruction each calendar year. Such classroom instruction shall relate to the operations of the office of the circuit clerk and approved by a professional association of the circuit clerks of Missouri.

2. The professional association approving the program shall provide a certificate of completion to each clerk who completes the training program and shall send a list of certified clerks to the clerk of the supreme court.

Section 2. Upon the effective date of this section, in addition to all other legal costs in each civil suit, action, case, and all other proceedings of a civil nature filed in each circuit court and the divisions thereof, except the municipal and juvenile divisions, there shall be assessed and collected in the same manner as other civil court costs are collected, a sum of five dollars, and in all criminal cases a sum of two dollars, but no such costs shall be assessed when the costs are to be paid by the state or a political subdivision thereof for indigent defendants. The clerk or other official responsible for collecting court costs in such cases shall collect such amounts and remit them monthly to the department of revenue for deposit in the general revenue fund of the state.
