To amend chapter 644, RSMo, by adding thereto one new section relating to water quality certification.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF MISSOURI,

AS FOLLOWS:

Section A. Chapter 644, RSMo, is amended by adding thereto one new section, to be known as section 644.150, to read as follows:

644.150. The department shall complete review and issue or deny water quality certification within ninety days following issuance of a joint public notice by the United States Army Corps of Engineers regarding an application required under section 404 of Public Law 92-500, 33 U.S.C. 1344, regardless of any ongoing review conducted by any federal agency on the application. The certification shall be deemed issued if the department fails to issue or deny water quality certification within ninety days following issuance of the joint public notice.
