To amend chapter 197, RSMo, by adding one new section relating to the regulation of abortion clinics.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF MISSOURI,

AS FOLLOWS:

Section A. Chapter 197, RSMo, is amended by adding thereto one new section, to be known as section 197.245, to read as follows:

197.245. 1. For the purposes of section 197.200 through 197.240, an "abortion facility" shall mean any place which is advertised or held out to the public as providing abortion services and in which an average of at least two abortions per month have been performed in the previous year but shall not include a hospital.

2. No abortion clinic shall begin operation after the effective date of this act without a license. Any abortion facility in operation on the effective date of this act shall apply for a license under sections 197.200 to 197.240 by December 1, 1996.
