To amend chapter 362, RSMo, by adding thereto one new section relating to banking.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF MISSOURI,

AS FOLLOWS:

Section A. Chapter 362, RSMo, is amended by adding thereto one new section, to be known as section 362.616, to read as follows:

362.616. 1. Notwithstanding any other provision of law to the contrary, a bank organized under the laws of Missouri or a national bank the home state of which is Missouri may engage in a merger transaction with an out-of-state bank in accordance with section 44 of the Federal Deposit Insurance Act.

2. An out-of-state bank may not acquire a branch of a bank organized under the laws of Missouri or a national bank the home state of which is Missouri without acquiring the bank.

3. As used in this section, the terms "bank", "branch", "home state", "merger transaction" and "out-of-state bank" have the same meaning as in the Federal Deposit Insurance Act (12 U.S.C. 1811, et seq.).
