AN ACT

To repeal section 306.110, RSMo 1994, relating to public safety offenses, and to enact in lieu thereof three new sections relating to the same subject, with penalty provisions.


Be it enacted by the General Assembly of the State of Missouri, as follows:

Section A. Section 306.110, RSMo 1994, is repealed and three new sections enacted in lieu thereof, to known as sections 306.110, 577.115 and 577.120, to read as follows:

306.110. 1. No person shall operate any motorboat or watercraft, or manipulate any water skis, surfboard or other waterborne device in a reckless or negligent manner so as to endanger the life or property of any person.

2. No person shall operate any motorboat or watercraft, or manipulate any water skis, surfboard or other waterborne device while intoxicated or under the influence of any narcotic drug, barbiturate or marijuana.

3. No person shall commit the offense of reckless endangerment of passengers of a commercial passenger boat. The term reckless endangerment of passengers of a commercial passenger boat means the unauthorized act of jumping or diving from a commercial passenger boat into the surrounding water. Reckless endangerment of passengers of a commercial passenger boat is a class C misdemeanor.

577.115. 1. No person shall jump or dive from any public bridge where it crosses a river or lake within the boundaries of this state.

2. Any person violating subsection 1 of this section shall be guilty of a class C misdemeanor.

577.120. 1. No person shall enter upon any privately owned railroad bridge without the specific authorization of the owner.

2. Any person violating subsection 1 of this section shall be guilty of an infraction.
