ASSUMPTION
No fiscal impact would be expected on the budget of the Motor Vehicle
Commission as a result of this proposal.
Officials from the Department of Revenue (DOR) stated that the administrative
impact of this proposal on DOR is unknown at this time. DOR stated that due
to the restrictions on the sale of driver's and motor vehicle records, there
would be a loss to the Information Fund; however, it would be impossible to
predict how many individuals would opt to restrict the disclosure of personal
information. Therefore, the actual Information Fund loss is unknown.

DESCRIPTION
The proposed legislation would prohibit Department of Revenue employees from
disclosing personal information contained in the motor vehicle or driver's
license records unless under specific conditions. Personal information and
allowable disclosures defined. Authorized recipient may not redisclose
personal information. All request for information shall be made in writing
and shall be recorded in the record of the individual to whom the record
pertains. Any individual may review his or her own records upon request and
payment of a fee. Any person violating the provisions is guilty of a class A
misdemeanor. The second and subsequent conviction of violating the
provisions a class D felony.
This legislation is not federally mandated, would not duplicate any other
program and would not require additional capital improvements or rental
space.
