FISCAL ANALYSIS
ASSUMPTION
Officials from the Raytown, and LeMay Fire Protection Districts assume no
fiscal impact to their fire districts.
Officials from the Chesterfield Fire Protection District assume that the
provisions contained in this proposal could create the potential for fiscal
impact to their fire district. Officials stated they anticipate a petition
would be filed if this proposal were adopted. Officials estimate that fiscal
impact could total as much as $5,000 per day in delays, and legal fees. If
construction of the new firehouse were to be halted permanently cost to the
district could total as much as $1,200,000.
Oversight assumes that section 321.500 currently allows voters of a district
to file an initiative or referendum petition. Oversight assumes that new
language would expedite the petition process. Oversight assumes no fiscal
impact to state funds.

DESCRIPTION
This act would ensure that residents of an area annexed after May 26, 1994,
could vote in all fire protection district (FPD) elections and could be
elected to the district's board of directors. Section 72.418 will not expire
on December 31, 2002.
If an initiative or referendum petition is presented to the Chesterfield FPD
board and is signed by at least 25% of the number of voters voting in the
last FPD election, the board will submit the question pursuant to the order
or demand of the petition.
A circuit court having jurisdiction over the Chesterfield FPD could stay any
action of the district upon the filing of an emergency petition signed by 100
voters in the district. This section will expire on May 1, 1997.
Any fire protection district in the State could contract the fire services of
the district to a private company upon voter approval.
Certain sections of this act have an emergency clause.
This legislation is not federally mandated, would not duplicate any other
program and would not require additional capital improvements or rental
space.
