FISCAL ANALYSIS
ASSUMPTION
Officials of the Department of Social Services do not expect legislation
affecting children receiving alternative care in the Division of Family
Services due to this proposal.
Department of Elementary and Secondary Education officials said that they
could not estimate an impact due to this proposal until enabling legislation
was adopted or clarifying court decisions were issued.
Oversight assumes the effects of this proposal would be decided by enabling
legislation and results of litigation filed under terms of the proposal.
Advertisement costs for the proposal would be $1,220 per newspaper column
inch for the text of the proposal, the introduction, title, fiscal note
summary, and affidavit. The proposal would be on the ballot for the November
1996 general election.

DESCRIPTION
This proposal would add a section to article I of the Missouri Constitution.
The new section would say the rights of parents to direct the upbringing and
education of their children would not be infringed. Nothing in this proposal
would be construed to affect any law regarding abuse or neglect.
The General Assembly would have authority to pass enabling legislation to
carry out provisions of the proposal.
This legislation is not federally mandated, would not duplicate any other
program and would not require additional capital improvements or rental
space.
