HB 0879 | Adoption of Building Codes |
SCS/HS/HB 879 - This act permits counties to adopt and enforce all or part of any of the five nationally recognized model building codes, upon approval of the voters of the county. Counties which adopt a building code pursuant to this act may also repeal such code, upon voter approval.
Any political subdivision that has adopted a building code before January 1, 1996 may elect to retain its code and enforcement authority, and remain separate from the rest of the county. Any county or fire protection district may contract with any other political subdivision to administer and enforce a building code. Political subdivisions may adopt ordinances prescribing fines for violations of their building codes.
Any building or structure owned and operated by an individual, a family or a family farm corporation which is used predominantly for agricultural purposes is exempt from the provisions of this act. A building or structure which is used as a habitat for any person must comply with the code, if any, adopted by the political subdivision.
Building code inspectors must be certified as proficient in
the building code in use by the political subdivision, must be
licensed by such political subdivision, must maintain a $25,000
bond and must provide proof of at least eight hours of continuing
education each year.
