To amend chapter 217, RSMo, by adding thereto one new section relating to offender education.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF MISSOURI, AS FOLLOWS:

     Section A. Chapter 217, RSMo, is amended by adding thereto one new section, to be known as section 217.357, to read as follows:

     217.357. 1. There is established a fund to be located in the state treasurer's office known as the "Post-Secondary Education Fund". The purpose of the fund is to assist inmates in the state correctional system who want to pursue post-secondary education.

     2. The department shall deposit all profits collected from the operation of the inmate phone system into the post-secondary education fund. The monies in the fund shall not revert or be transferred to general revenue, notwithstanding the provisions of section 33.080, RSMo, to the contrary. The department shall maintain accurate records of the amount of monies in the post-secondary education fund. Monies from the fund shall, subject to appropriation, be allocated to each correctional facility.
