     To amend chapter 701, RSMo, by adding one new section relating to grinder pump pressure sewer systems.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF MISSOURI, AS FOLLOWS:
     Section A. Chapter 701, RSMo, is amended by adding one new section, to be known as section 701.024, to read as follows:
     701.024. 1. Grinder pump pressure sewer systems may be used as a means of sanitary sewer collection for new and existing construction as provided in this section. A Missouri-licensed professional engineer may determine that a grinder pump pressure collection system is appropriate for a particular application, and the department of natural resources shall accept such determination. A Missouri-licensed professional engineer shall have sole responsibility to determine operation and maintenance costs for such systems, and such determination shall be accepted by the department in all applications, including state-licensed sewer construction programs.
     2. A publicly-owned treatment works shall be responsible for the entire public sewer system, except that the operation and maintenance of any part of an individual's pressure sewer system, including grinder pumps and service lateral to the system used for the purpose of collecting or conducting wastewater originating at a residence or individual commercial entity, shall be the responsibility of the owner of such residence or individual commercial entity unless the publicly-owned treatment works has assumed such responsibility.
