To amend chapter 115, RSMo, by adding thereto one new section relating to term limits for federal officers.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF MISSOURI, AS FOLLOWS:

     Section A. Chapter 115, RSMo, is amended by adding thereto one new section, to be known as section 115.376, to read as follows:

     115.376. Prior to the close of candidate filing, or in the case of a candidate filing for office pursuant to the provisions of sections 115.361, 115.363 or 115.377, when the candidate's declaration of candidacy is filed with the secretary of state, each non-incumbent candidate for the offices of United States Senator or United State Representative shall file either a written term limits pledge pursuant to article VIII, section 18 of the Missouri Constitution or a written statement declining to take the term limits pledge set forth in the Missouri Constitution. The written pledge or statement declining to take the pledge shall be subscribed and sworn to by the candidate before the election official accepting the candidate's declaration of candidacy, a notary public or other officer authorized by law to administer oaths. The written pledge or statement declining to take the pledge shall be in substantially the following form:

I support term limits and pledge to use all my legislative powers to enact the proposed constitutional amendment set forth in Article VIII, Section 18 of the Missouri Constitution. If elected, I pledge to vote in such a way that the designation "DISREGARDED VOTERS' INSTRUCTIONS ON TERM LIMITS" will not appear adjacent to my name.

Any non-incumbent failing to timely file either the written pledge or statement declining to take the pledge shall have the information "DECLINED TO PLEDGE TO SUPPORT TERM LIMITS" printed on the ballot adjacent to the candidate's name.
