AN ACT

     To amend chapter 67, RSMo, by adding thereto three new sections relating to sports complex authorities.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF MISSOURI, AS FOLLOWS:

     Section A. Chapter 67, RSMo, is amended by adding thereto three new sections, to be known as sections 67.597, 67.598 and 67.599, to read as follows:

     67.597. There is hereby authorized to be created in any city not within a county a special authority to be known as the "................ City Sports Complex Authority", hereinafter referred to as the "authority". Such authority shall be created by order of the governing body of such city and certified copies of said order shall be filed in the offices of the governor, secretary of state and revisor of statutes.

     67.598. 1. The city sports complex authority shall consist of five commissioners who shall be qualified voters of the state of Missouri. The members of the governing body of said city, by majority vote thereof, shall submit a panel of nine names to the governor who shall select with the advice and consent of the senate five commissioners from such panel, no more than three of which shall be of any one political party, who shall constitute the members of said authority; provided, however, that no elective or appointed official of the state of Missouri shall be a member of a city sports complex authority. Two commissioners shall reside in any city not within a county, one commissioner shall reside in a first class county adjoining any city not within a county, and two commissioners shall reside in the state of Missouri but not within such city or county.

     2. The authority shall elect from its number a chairperson and may appoint such officers and employees as it may require for the performance of its duties and fix and determine their qualifications, duties and compensation. No action shall be binding unless taken at a meeting at which at least three members are present and unless a majority of the members present at such meeting shall vote in favor thereof.

     3. The sports complex commissioners, first appointed, shall serve for the following terms: One for two years, one for three years, one for four years, one for five years, and one for six years. Successors shall hold office for terms of five years, or for the unexpired terms of their predecessors. Each sports commissioner shall hold office until his or her successor has been appointed and qualified.

     4. In the event a vacancy exists, a new panel of three names shall be submitted by majority vote of the governing body to the governor for appointment. All such vacancies shall be filled within thirty days from the date thereof.

     5. No compensation shall be payable to the sports complex commissioners by the authority, but the sports complex commissioners shall be reimbursed by the authority for the actual and necessary expenses incurred in the performance of their duties.

     67.599. The duties of the authority shall include, but not be limited to, the study and review of all current major sports leagues, clubs or franchises operating in any city not within a county and the analysis of possibilities for future growth and expansion of existing and new major sports leagues, clubs or franchises in that and surrounding areas. Unless and until otherwise provided, the authority shall make an annual report to the governor, setting forth in detail its findings and recommendations.
