HCS/SS/SB 22 - This act makes several changes regarding higher education.
COORDINATING BOARD FOR HIGHER EDUCATION - Current law provides that members of the Coordinating Board may not be employed as an educator or educational administrator while serving on the Board. The act provides that this limitation shall only apply to employment at an institution under the jurisdiction of the Coordinating Board.
LINN STATE TECHNICAL COLLEGE - This act provides that bonded indebtedness incurred by Linn State Technical College shall not be deemed an indebtedness of the state or the Board of Regents of the College. Existing law provides that such indebtedness shall be an indebtedness of the Board of Regents after the Linn State Technical College is established under Section 178.631, RSMo.
The act provides, in the definition of Linn State Technical College, that the institution is a public institution of higher education subject to the approval of the Coordinating Board for Higher Education. Linn Technical College has historically been accredited as a secondary school with adult programs.
ADMINISTRATIVE RULES - The act places any rule promulgated under
its authority under certain standards for withstanding a court
challenge, requires the court to award reasonable fees and
expenses to any prevailing party in such a challenge, and
requires that rules promulgated pursuant to the substitute expire
on August 28th of the year after they become effective unless
extended by statute. These rules provisions have a conditional
termination date.
