Current Bill Summary

SCS/SBs 244 & 312 - This act creates two new crimes relating to prostitution and requires HIV testing for a person convicted of prostitution. Finally, a court may order a person convicted of prostitution to participate in a drug and alcohol abuse program. If the person successfully completes such program, the court may reverse such conviction.

NEW CRIMES: A person who has tested positive for HIV, knows or should have known of this positive test, and commits the crime of prostitution is guilty of a Class C felony.

A person who is convicted of prostitution and: 1) at the time of arrest possesses illegal drugs; and 2) has been previously convicted of prostitution, is guilty of a Class C felony.

This act is similar to SB 790 from 1996.
