Current Bill Summary

SS/SB 275 - This act defines "partial birth abortion" as a method or technique of abortion in which the person performing the abortion partially vaginally delivers a living fetus before intentionally killing the infant and completing the delivery.

The act also states that no physician shall perform a partial birth abortion unless necessary to preserve the life of the mother. Any physician who performs a partial birth abortion when it is not necessary to safe the life of the mother shall be guilty of a Class D felony. The act further states that any person who takes the life of a child aborted alive is guilty of 2nd degree murder.
