SB 395 - This act would address a problem in the recall process for 3rd class cities which effectively could bar voters in certain 3rd class city wards from recalling their elected city officials.
Section 77.650 requires a petition for recall to be signed
by registered voters "entitled to vote for a successor to the
incumbent sought to be removed", but the number of signatures
required must be equal to 25% of the total number of registered
voters in the entire city. This act would change the petition
number to 25% of the total number of registered voters who are
eligible to vote for the officer being recalled.
