SB 439 - This act regulates the relationship between gas and electric utilities and entities that sell, repair or install utility-related equipment in an affiliation with a utility. Utility is defined broadly in this act .
A utility may not provide such services except through an affiliate unless it has been doing so for five years (primarily Rural Electric Cooperatives). The utility may not grant or provide any unfair privilege to the affiliate, may not direct customers to the affiliate, and may not provide financial support to the affiliate. An affiliate may not use a name similar to that of the utility nor co-locate its business with the utility. Violation of these provisions is a felony and subject to a fine of up to $25,000.
The Public Service Commission has jurisdiction over
utilities and their affiliates.
