ASSUMPTION
Officials from the Office of State Courts Administrator believe this
legislation would result in a slight increase in the number of adoption
cases; however, they do not anticipate any significant fiscal impact.
Officials from the Department of Social Services indicate this legislation
would not have a fiscal impact on their agency.

FISCAL IMPACT - Small Business
No direct fiscal impact to small businesses would be expected as a result of
this proposal.
DESCRIPTION
This legislation would provide that the division of family services, courts,
and all people involved in the adoptive placement of children recruit
potential adoptive homes that reflect the ethnic and racial diversity of
children for whom adoptive homes are needed. In the selection of an adoptive
home, consideration of a child's cultural, racial, and ethnic background and
the capacity of the adoptive parents to meet the needs of a child of a
specific background shall be given. Placement of a child in an adoptive home
may not be delayed or denied solely on the basis of race, color, or national
origin.
It would also allow the agency and court to give first preference for
adoptive placements to foster parents, if bonding has occurred as evidenced
by the positive emotional and physical interaction between the foster parent
and child.
This legislation is not federally mandated, would not duplicate any other
program and would not require additional capital improvements or rental
space.
