ASSUMPTION

The Department of Public Safety, Division of Liquor Control, the Office of
State Courts Administrator, the Gaming Commission, the Office of Prosecution
Services, and the State Public Defender assume this proposal would not
fiscally impact their agencies.

FISCAL IMPACT - Small Business

This proposal would affect small businesses who choose to use such gambling
devices, as these businesses may realize revenues from them.



DESCRIPTION

This proposal excludes from the definition of gambling or gambling device any
amusement device that confers only an immediate right of replay or a coupon
or credit that can be redeemed on the premises for something of value (other
than beer, liquor, or tobacco products) if it does not exceed twenty-five
dollars.

This legislation is not federally mandated, would not duplicate any other
program and would not require additional capital improvements or rental
space.
