ASSUMPTION
Officials of the Department of Public Safety - Missouri State Water Patrol
(MSWP) assumed that this proposal would have no fiscal impact to their
agency.
In response to a nearly identical proposal in the previous legislative
session MSWP officials noted that although there was no fiscal impact to
implement the proposal, there could be an impact for failure to enact the
proposal. When the state's water safety laws do not conform to federal laws,
the U. S. Department of Transportation - U. S. Coast Guard can withhold the
U. S. Coast Guard Grant of approximately $640,000 to the MSWP.
Officials of the Office of the Attorney General assume that the proposal
would have no fiscal impact to their agencies.
Officials of the Department of Revenue assume that this proposal would result
in procedural changes, but would have minimal fiscal impact to their agency.

FISCAL IMPACT - Small Business
No direct fiscal impact to small businesses would be expected as a result of
this proposal.
DESCRIPTION
This proposal would require every watercraft 16 feet or more in length,
except canoes, to have at least one wearable type I, II, or III and at least
one type IV throwable personal flotation device on board. Canoes and kayaks
16 feet or over would be exempted from the requirements for carriage of the
additional type IV personal flotation device. Sailboards, racing shells,
racing canoes, racing kayaks, and rowing sculls would be exempted from the
carriage of any type flotation device. A type V personal flotation device
could be carried in lieu of any personal flotation device required by this
proposal, if the device had a United States Coast Guard approval label and
was being used in accordance with any requirements on the label or owner's
manual.
It would require every canoe 16 feet or more in length to have on board at
least one type IV throwable personal flotation device for each person on
board.
A penalty fee or cancellation could only be imposed under this proposal upon
a person who documented a vessel with the United States Coast Guard prior to
August 28, 1994, if that person had received at least thirty days notice that
registration of such vessel was required with the Department of Revenue.
This legislation is federally mandated (Federal Code of Regulation - Title 46
Chapter 43 Section 4306, related to federal preemption). It would not
duplicate any other program and would not require additional capital
improvements or rental space.
