FISCAL ANALYSIS
ASSUMPTION
Officials from the Office of State Courts Administrator (CTS) assume the
proposed legislation would modify the salary provisions of circuit court
marshals in the 24th and 43rd circuits. CTS reports that the 24th and 43rd
circuits are multi-county circuits and that current statutes do not allow a
court marshal's salary to exceed 90% of the lowest paid sheriff in the
circuit. This proposal would increase the court marshal salary limits to 90%
of the highest paid sheriff in the circuit.
CTS reports that the sheriffs' salaries are controlled by local salary
commissions and are not reported centrally. For purposes of this proposal,
CTS has used the salaries in effect in 1996. CTS officials assume the court
marshal salaries in the 24th and 43rd circuits would be increased to 90% of
the highest paid sheriff in each circuit, resulting in an annual cost of
$18,846 plus fringe benefits. The salary increases would be as follows:
24th Circuit -- increase from $26,010 to $36,000 annually (increase of
$9,990)
43rd Circuit -- increase from $22,644 to $31,500 annually (increase of
$8,856)
Oversight assumes this proposal would allow the presiding judges in the 24th
and 43rd circuits to increase their court marshals' salaries to 90% of the
highest paid sheriff in the circuit. However, an increase in salary would
require the approval of the presiding judge and would not be automatic.
Therefore, Oversight has ranged the cost of this proposal from zero to
$18,846 annually.
Officials from the Missouri Sheriffs' Association assume this proposal would
have no fiscal impact on their agency.
Officials from the Greene County Sheriff's Department, the St. Louis County
Sheriff's Department, and the Jackson County Sheriff's Department did not
respond to our fiscal note request.

No direct fiscal impact to small businesses would be expected as a result of
this proposal.
DESCRIPTION
This proposal would set the maximum salary of a circuit court marshal at 90%
of the salary of the highest paid sheriff serving a county either wholly or
partly in the circuit. Current law sets the marshal's maximum salary at 90%
of the salary of any sheriff serving a county wholly or partly in the
circuit.
This legislation is not federally mandated, would not duplicate any other
program and would not require additional capital improvements or rental
space.
