                              FISCAL ANALYSIS

ASSUMPTION

Officials of the Gaming Commission assume this proposal would not fiscally
impact their agency.

Officials of the Office of the State Courts Administrator assume this
proposal would have a minimal fiscal impact on their agency.

Officials of the Office of the State Public Defender (SPD) assume that any
costs incurred as a result of this proposal could be absorbed with existing
resources.  However, passage of more than one similar bill could require the
SPD to request increased appropriations to cover the cumulative cost of
representing the indigent accused.

Officials of the Office of Prosecution Services assume this proposal would
not fiscally impact their agency.  They indicated that this proposal creates
a new misdemeanor offense, which could cause increased workload for
prosecutors with riverboats in their jurisdiction; however, actual fiscal
impact on these jurisdictions is not known.

Oversight assumes that those prosecutors affected by this proposal would
request additional resources as needed through regular local government
budgeting procedures, and is therefore showing no local fiscal impact.

FISCAL IMPACT - Small Business

No direct fiscal impact to small businesses would be expected as a result of
this proposal.


DESCRIPTION

This proposal would prohibit individuals under the age of 21 from entering or
attempting to enter an excursion gambling boat and making or attempting to
make a wager on an excursion gambling boat.  Violations of this proposal
would be punishable as a class C misdemeanor.  In addition, it allows the
commission to create a "List of Excluded Persons" who would be barred from
entering an excursion gambling boat.  Persons on this list would include
those convicted of crimes of moral turpitude or having a notorious or
unsavory reputation.  Violations of this proposal would be punishable as a
class B misdemeanor.

This proposal also prohibits cities, counties, and urban redevelopment
corporations from acquiring real property by exercise of its power of eminent
domain for the purpose of locating an excursion gambling boat.

This legislation is not federally mandated, would not duplicate any other
program and would not require additional capital improvements or rental
space.
