                              FISCAL ANALYSIS
ASSUMPTION

Officials from the Office of State Courts Administrator assume the proposed
legislation may result in some increase in the number of cases filed;
however, they would not anticipate a significant impact on the workload of
the courts.

Officials from the Office of the State Public Defender (SPD) assume existing
staff could represent the expected 15 to 20 additional cases that might arise
as a result of this proposal.  However, passage of more than one similar
proposal could require the SPD to request increased appropriations to cover
the cumulative cost of representing the indigent accused.

Officials from the Office of Prosecution Services (OPS) assume the proposal
could increase the workload of some county prosecutors; however, OPS assumes
that any impact would be minimal and could be absorbed with existing
resources.

Officials from the Missouri Sheriffs' Association, the Missouri Police
Chiefs' Association, the Office of the Attorney General, the City of St.
Louis Police Department, and the Greene County Sheriff's Department assume
this proposal would have no fiscal impact on their agencies.


In response to a similar proposal, officials from the City of Springfield
Police Department reported there would be no fiscal impact on their agency.

Officials from the Jackson County Sheriff's Department, the Kansas City
Police Department, and the St. Louis County Police Department did not respond
to our fiscal note request.

Based on the fiscal note responses received, Oversight assumes this proposal
would not result in a significant fiscal impact for any local law enforcement
agency.

FISCAL IMPACT - Small Business

No direct fiscal impact to small businesses would be expected as a result of
this proposal.


DESCRIPTION

The proposal would extend the establishment of the crime "misuse of emergency
telephone service" from Greene County to the whole state.  This crime would
be punishable as a Class B misdemeanor.  An individual would commit the crime
of misusing the emergency telephone service if he repeatedly (defined in the
proposal as more than three times in one month) called "911" for
non-emergency situations or if he purposely reported false emergency
situations.

This legislation is not federally mandated, would not duplicate any other
program and would not require additional capital improvements or rental
space.
