                              FISCAL ANALYSIS


ASSUMPTION

Officials of the Missouri Gaming Commission (GAM) and Department of Economic
Development (DED) assume no fiscal impact.

Officials of the Office of State Courts Administrator (CTS) assume that a
case could arise as a result of this legislation, however, officials assume
no fiscal impact to the state's judiciary.

The Gasconade County Commission assumes no fiscal impact to their county.

City of Lexington officials stated the city's proposed project with Concorde
Gaming Corporation is structured on that Corporation's direct purchase and
ownership of the property involved, and no municipal monies are being used or
proposed for use in the development for excursion boat gambling.  Officials
assume no fiscal impact.

Officials of Cooper County and the City of Boonville submitted the following
joint statement.  Officials stated that the City of Boonville has a
contractual obligation with Davis Gaming of Boonville to construct a
riverfront redevelopment project a portion of which includes gaming.
Officials stated that without the use of eminent domain some of the necessary
property could not be acquired, therefore, officials assume that the project
would be in jeopardy and could result in the project not being completed.
Officials stated that if the project would not be completed there would be a
loss to the city and county in the form of loss of revenue from property
taxes, capital improvements, sales taxes, and payroll to workers.  Officials
estimated a loss in FY98 at $75,224,000; FY99 at $14,749,005; and FY2000 at
$17,387,656.

Oversight assumes that by restricting local authorities from using the power
of eminent domain or local government funds to acquire property for
developing riverboat gambling projects would have no direct local impact, but
could increase property costs for developers.  For the purposes of this
fiscal note Oversight assumes no state or local fiscal impact.

FISCAL IMPACT - Small Business

No direct fiscal impact to small businesses would be expected as a result of
this proposal.


DESCRIPTION

This act will prohibit any authority, city, county or urban redevelopment
corporation from acquiring any real property by eminent domain for the
purpose of locating an excursion gambling boat which is not yet licensed by
the Missouri Gaming Commission.  The act also prohibits the use of General
Revenue or other funds acquired by the authority to acquire real property for
this purpose.  The provisions of this act would not apply to a first class
county or to any authority, city, or urban redevelopment corporation located
in a first class county or to any political subdivision located along the
Mississippi River.

This legislation is not federally mandated, would not duplicate any other
program and would not require additional capital improvements or rental
space.
