ASSUMPTION
Officials of the Office of State Courts Administrator, the Department of
Health, the Department of Insurance, the Attorney General's Office, the
Department of Social Services, and the Office of Prosecution Services assume
this proposal would have no fiscal impact on their agency.
Officials of the State Public Defender (SPD) assume that existing resources
could be used to handle "partial birth abortion" cases. However, passage of
more than one similar proposal would require SPD to request increased
appropriations to cover the cumulative costs.

No direct fiscal impact to small businesses would be expected as a result of
this proposal.
DESCRIPTION
This legislation defines "partial birth abortion" and states that no
physician shall perform a partial birth abortion unless necessary to preserve
the life of the mother. Any person who performs a partial birth abortion
will be guilty of 2nd degree murder.
This legislation is not federally mandated, would not duplicate any other
program and would not require additional capital improvements or rental
space.
