FISCAL ANALYSIS
ASSUMPTION
The Department of Social Services and the Department of Elementary and
Secondary Education assume this proposal would have no fiscal impact on their
agencies.
The Department of Mental Health (DMH) states that although this proposal
gives more flexibility in the types of services that a SB40 Board can
perform, it will not cause a fiscal impact on DMH. DMH further states that
any increased services would be funded by an increased local tax levy that
would need to be a part of a county vote.

FISCAL IMPACT - Small Business
No direct fiscal impact to small businesses would be expected as a result of
this proposal.
DESCRIPTION
This proposal permits county boards to enter into cooperative or contractual
agreements with other governmental entities to serve eligible people. When
so cooperating, the board may serve persons other than those who qualify for
services under their authority, provided that none of the boards' local funds
are used for such services. The proposal also provides that county boards
can direct the use of local tax revenues for any authorized purpose. In
addition, the proposal changes the age of eligibility under the definition of
a disability from a condition which originated before age eighteen to one
that originated before twenty-two years of age.
This legislation is not federally mandated, would not duplicate any other
program and would not require additional capital improvements or rental
space.
