FISCAL ANALYSIS
ASSUMPTION
Officials from the Department of Agriculture (AGR) assume the proposed
legislation would have no fiscal impact on their agency. The proposal would
move the moisture meter registration program from Chapter 265 to Chapter 413,
so that it is included in the Weights and Measures Law. Since the
registration program is already being administered, there would be no
increase or decrease to general revenue.
Oversight assumes there would be a potential for an increase in general
revenue due to collection of penalties for violations. The proposal would
provide that violators may be required to pay a penalty of not more than $500
per violation and $500 for each day such violation continues.

No direct fiscal impact to small businesses would be expected as a result of
this proposal.
DESCRIPTION
The proposed legislation would include the moisture meter registration
program in the Weights and Measures statutes, Chapter 413, RSMo. Currently,
this program is contained in Chapter 265. Also, the proposal would
strengthen enforcement provisions by allowing formal and informal hearings to
address violations. Violators could be required to pay a penalty of not more
than $500 per violation and $500 for each day such violation continues.
This legislation is not federally mandated, would not duplicate any other
program and would not require additional capital improvements or rental
space.
This proposal could affect Total State Revenue.
