No fiscal impact to small businesses would be expected as a result of this
proposal.
DESCRIPTION
This act would address a problem in the recall process for 3rd class cities
which effectively could bar voters in certain 3rd class city wards from
recalling their elected city officials.
Section 77.650 requires a petition for recall to be signed by registered
voters "entitled to vote for a successor to the incumbent sought to be
removed", but the number of signatures required must be equal to 25% of the
total number of registered voters in the entire city. This act would change
the petition number to 25% of the total number of registered voters who are
eligible to vote for the officer being recalled.
This legislation is not federally mandated, would not duplicate any other
program and would not require additional capital improvements or rental
space.
